We delivered justice to a woman whose spine was crushed when the Yamaha four-wheel all-terrain vehicle she was driving flipped over. While the woman tried to reach a settlement with Yamaha, the company refused her offer, claiming that she was at fault by riding the ATV in an unsafe manner.
Not only did witnesses to the accident testify that she was not driving the ATV unsafely, we proved to the jury that Yamaha used farm-equipment suspension on a vehicle advertised for recreational use.
As a result of this product defect, the jury awarded our firm’s client $3.6 million.
This was the first verdict in the United States against a four-wheel ATV manufacturer.
